歐洲專利局拒絕俄羅斯國籍之EPC專利權人請求UP

歐洲聯盟理事會 (Council of the European Union) 於2024年6月發布第14輪針對俄羅斯的制裁後，歐洲專利局在2024年7月採取預防措施，暫停涉及俄羅斯國籍之EPC專利權人提交或共同提交的UP請求程序。
而在與歐洲委員會 (European Commission) 與行政專責委員會 (Select Committee of the Administrative Council) 討論後，歐洲專利局已有實施制裁的結論。
簡言之，根據歐盟專利 (Unitary Patent, UP) 規則新增有關涉及智慧財產權的處理，歐洲專利局根據歐盟專利規則 (Unitary Patent Rule) 第7(2)條，倘EPC專利權人或其中之一為俄羅斯國籍者，歐洲專利局將會拒絕其UP請求。
然歐洲專利局擬根據該規則拒絕UP請求前，仍會發出通知，給予EPC專利權人答覆的機會，EPC專利權人可援引相關適用條款提出答辯。
