An applicant can apply for AEP if the request for substantive examination of an application has been filed and the application is still pending. However, if the applicant has received any Official Letter and the claims have been narrowed, the applicant cannot apply for AEP based on the granted claims in foreign countries with wider scopes than those in the Taiwan case.
